The Children’s Movement of Florida Dream Prizes Sweepstakes
Important: Please read these Official Rules before entering this online sweepstakes promotion (the "Promotion" or “Sweepstakes”). By participating in the Promotion, you agree to be bound by these Official Rules and represent that you satisfy all of the eligibility requirements below.
NO PURCHASE, PAYMENT, OR FINANCIAL CONTRIBUTION OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS PROMOTION.
1. Eligibility. OPEN ONLY TO INDIVIDUAL UNITED STATES CITIZENS WHO ARE FLORIDA RESIDENTS, 18 OR OVER. PROMOTION OFFERED ONLY IN FLORIDA; VOID IN ALL OTHER JURISDICTIONS & WHERE PROHIBITED BY LAW. Directors, officers and employees of The Early Childhood Initiative Inc. a.k.a. The Children’s Movement of Florida (the “Sponsor”), its parent company, affiliate companies, subsidiaries, advertising and promotional agencies (including LeadDog Marketing Group, Inc., the independent judging agency; the “Judges”), and prize providers (collectively, the “Promotion Parties”), and immediate families of each are not eligible for the Promotion. For the avoidance of doubt, persons who perform volunteer work for Sponsor (but are not compensated by Sponsor) are eligible for the Promotion.
2. Disclaimer. Promotion Parties are not responsible for: (a) any late, lost, misrouted, incomplete, misdirected, illegible, garbled or distorted or damaged e-mail transmissions or entries or for postage due mail (all of which are void); (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures, regardless of cause; (c) any Promotion disruptions, injuries, losses or damages caused by events beyond the control of Sponsor and/or Judges or by non-authorized human intervention; or (d) any printing or typographical errors in any materials associated with the Promotion.
3. Promotion Period/Entry Limitations. The Promotion starts on or about 12:00 a.m. Eastern Time (“ET”) on September 24, 2011 and ends at 11:59 p.m. ET on December 31, 2011 (the "Promotion Period"). See also Rule 7 below. There will be a limit of ten (10) entries of any kind (i.e., with or without contribution) per person, per prize, during the Promotion Period. Multiple entries in excess of the maximum of ten (10) entries per person, per prize, will be disqualified.
4. Prizes: One (1) winner per Prize.
(a) Brickell Motors Three year car lease: (Approximate retail value of the prize: $11,197)
An all-new 2012 Honda Civic LX for a period of 36 months in the form of a pre-paid closed-end vehicle lease. The prize provider (Brickell Motors, Inc., of Miami, Florida) will determine all features of automobile including but not limited to color of exterior and interior, and all other features or upgrades will be allowed only if permitted by delivery dealer and paid for by Winner. Winner must be a licensed driver and will be required to provide proof of insurance at time of delivery and during the term of the lease. The insurance coverage requirements will be determined by the lessor. Winner must have credit that will qualify for approval for the lease of the vehicle. Winner is solely responsible for title, license, registration, dealer preparation costs, auto insurance and other fees associated with prize. Winner must take delivery of prize from Brickell Motors. If the 2012 Honda Civic LX is not available within six (6) months of Winner verification for any reason, a pre-paid closed-end lease (for a period of 36 months) of a vehicle of comparable or greater value also from Brickell Motors (as selected by Sponsor in its sole discretion) will be awarded and will represent Sponsor’s sole obligation to Winner.
(b) Royal Caribbean International 7 night Caribbean Get-a-way (Approximate retail value of the prize: $2,000)
A 7-night Caribbean cruise for two in an oceanview cabin on board Royal Caribbean’s Freedom of the Seas. The cruise departs from Port Canaveral, Florida and cruise is valid for Eastern or Western Caribbean itineraries. Winner is solely responsible for port fees, taxes, and gratuities. Winner may pay to upgrade cabin and/or add a 3rd or 4th passenger to the cabin (based on availability). All bookings must be made no later then 7 days prior to sailing. The certificate expires October 31, 2012. Passport and all necessary travel documents are sole responsibility of winner and travel companion. Additional restrictions apply. Winner is solely responsible for transportation to/from Port Canaveral.
(c) Two American Airlines round-trip return business class tickets (Rio de Janeiro, Brazil). (Approximate retail value of the prize: $10,000)
*Travel must be via the most direct American Airlines/American Eagle routing. Unnecessary and circuitous routings, connecting points, and/or segments are prohibited. *When redeeming a Business Class letter and Business Class is not offered, travel will only be valid for Coach. *Maximum one stopover allowed on applicable routing. $100.00 USD Per Person Stopover Fee Applies. Tickets good for travel between any major airport serviced by American Airlines to South America. Tickets based on availability at time of reservation. Tickets (and award letters notifying winner/guest of receipt of prize) are non-transferable; award letters are not replaceable if lost or stolen and cannot be extended or renewed. Winner/guest not eligible for American AAdvantage mileage credit or any other promotional benefit that American Airlines may offer. Not valid for American Airlines codeshare flights. Travel must be via the most direct American Airlines/American Eagle routing to Rio de Janeiro, Brazil. Fees, taxes, surcharges, and service charges are the sole responsibility of the passenger (i.e., winner and his/her travel companion), including checked baggage fees and other airport related charges. Passport and all necessary travel documents are sole responsibility of winner and travel companion. Additional restrictions apply.
(d) Publix gift certificate (Approximate retail value of the prize: $6000)
Gift card may be used at any Publix store for the purchase of merchandise, other than lottery tickets, money services, or where prohibited by law. No expiration date. Gift card cannot be redeemed for cash or replaced if lost, stolen or damaged. For balance information refer to your last receipt or inquire at the customer service counter of any Publix store.
(e) The Florida Marlins all-star package (Approximate retail value of the prize: $800) {Approximate retail value DOES NOT represent resale value of Prize.)

(f) Miami Dolphins tickets sports package (Approximate retail value of the prize: $800)
-Miami Dolphins v. New York Jets Sun Life Stadium (January 1, 2012) -Four (4) club level tickets and one (1) VIP Parking Pass Tickets are not redeemable for cash.
(g) Romero Britto™ serigraph “Children of The World” limited edition serigraph on gesso, 2006 (29” x 24.5”) Edition number 77/100 (Approximate retail value of the prize: $2,710) {Approximate retail value DOES NOT represent resale value of Prize.)
(h) Family Adventure: River Ventures Manatee experience and Zoo Miami annual pass and behind the scenes tour.
River Ventures Manatee experience: (Approximate retail value of the prize: $250) River Ventures Manatee Experience to be awarded as a gift certificate. Gift certificate is subject to terms/conditions indicated thereon and is redeemable for family of 4 to swim with the manatees in Crystal River, Florida. No expiration date.
Zoo Miami Behind the scenes tour and annual pass: (Approximate Retail Value of the prize: $119) Zoo Miami Behind the Scenes Tour is a docent led tour at Zoo Miami. The Annual Pass to Zoo Miami grants the holder 365 days of fast, free admission to Zoo Miami, discounts on food, drinks and gifts, six 50% off passes for friends and 50% off at more than 150 zoos and aquariums nationwide.
5. Odds of Winning; Taxes; Additional Prize Restrictions. Odds of winning any prize depend on the number of eligible entries received for that prize. ALL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF WINNER. Winners of prizes valued at $600 or more will be issued an IRS 1099 Tax Form for the fair market value of the prize. If entering via contribution, your contribution to The Children’s Movement of Florida may not be tax deductible; you are advised to consult with your accountant or other tax professional as to this issue. All unspecified expenses as to acceptance and use of prize are the sole responsibility of the prize winner. Limit (1) prize per family, household or address. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize; this expressly excludes gift certificate prizes which may be redeemed for cash to the extent provided by law. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND BY SPONSOR OR JUDGES, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE); THE ONLY WARRANTIES ON PRIZES ARE THOSE OF THE PRIZE PROVIDER.
6. Identity of Entrant. In the event of a dispute about the identity of an online entrant, entry will be declared made by the individual who made the contribution to The Children’s Movement of Florida, as determined by Sponsor in its sole discretion.
7. How to Enter. Participants may enter as follows:
(a) FREE ENTRY METHOD (WITHOUT CONTRIBUTION TO SPONSOR): Send a 3”x5” card/paper with your name, address, daytime telephone number, date of birth and the words Dream Prizes Free Entry in a business-size (#10) envelope to: The Early Childhood Initiative Inc, 3250 SW Third Avenue Miami, FL 33129 Attn: "Free Entry into Dream Prize Promotion", to be postmarked by January 3, 2012 and received by January 10, 2012.
(b) Contribution Method: To enter by contributing money to Sponsor, complete and submit the contribution form at childrensmovementflorida.org/promo/Fall_promotion/ during the Promotion Period. You will receive one sweepstakes entry for every $25 contribution up to a maximum of 10 total entries per prize. Entering via the contribution method will not increase your chances of winning the prize.
Proof of contribution/online entry or proof of mailing 3”x5” card/paper entry (as appropriate) will not be deemed to be proof of receipt of entry by Sponsor. All entrants and entries are subject to verification by Sponsor. Mail entries will not be acknowledged or returned. Online entries will not be returned. By entering the Promotion, you consent to being placed on an e-mail mailing list for promotional and other purposes. Subject to Sponsor’s privacy policy found at http://childrensmovementflorida.org/privacy/.
8. Random Drawing. Judges will randomly select potential Winners from all eligible entries for each prize received during the Promotion Period, on or around January 12, 2012. Potential winners will be notified by email, mail or phone and may be required to sign and return an Affidavit of Eligibility, Liability & Publicity Release [where lawful] ("Affidavit"), which must be received by Judges within indicated time period. If a potential Winner cannot be contacted, or fails to sign and return the Affidavit within the indicated time period (as applicable), potential Winner forfeits prize without compensation of any kind and an alternate winner will be randomly selected from among all remaining eligible entries received. Travel companion of winner (for Prizes 4(b), 4(c)) will be required to sign and return a liability release and a publicity release (where lawful) prior to issuance of travel documents. If travel companion is a minor, releases must be signed by his/her parent or legal guardian; and, minor travel companion may only accompany his/her parent or legal guardian on trip (i.e., the prize winner).
9. General Release. By entering the Promotion, you release and agree to hold harmless Promotion Parties (and their respective employees, officers, directors, representatives, agents, shareholders, successors and assigns) from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Promotion or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
10. Use of Winner Name, Likeness, etc. Except where prohibited by law, acceptance of prize constitutes permission to use each winner's name, hometown, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation.
11. Winners List. For a copy of the winners list, after February 15, 2012, visit www.childrensmovementflorida.org/promo/Promotion_official_rules/ or send a stamped, self-addressed, business-size envelope for receipt by January 3, 2012 to Sponsor at the address listed below, Attn: "Children’s Movement Prize Promotion" Winner List.
12. Miscellaneous. The Promotion and these Official Rules will be governed, construed and interpreted under the laws of Florida, without regard to its or any other jurisdiction's choice of law/conflict of law provisions. To the fullest extent permitted by law, entrants agree that any action regarding the Sweepstakes or these Official Rules shall be brought individually (NOT as part of a class action) in a federal or state court situate in Miami-Dade County, Florida; and entrants agree to the personal jurisdiction of such courts and to waive any right of change of venue or any like right. Further, in any action, one’s recovery shall be limited to his/her actual out-of-pocket costs to participate in the Sweepstakes, with any and all other damages (including, by way of example only, incidental, consequential, compensatory or punitive damages) or other rights/remedies being waived. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor and Judges, which are final and binding in all respects. Sponsor reserves the right to modify, suspend or cancel the Promotion or any entrant's participation in the Promotion should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor's control affect the administration, security or proper play of the Promotion such that the Promotion cannot be conducted as originally planned (as determined by Sponsor in its sole discretion). In case of modification/suspension/cancellation, Sponsor will select prize winners from among all eligible entries received before and/or after (as appropriate) the action taken by Sponsor or otherwise in a manner determined by Sponsor in its sole discretion to be fair, appropriate and consistent with these Official Rules. Notice of such action by Sponsor shall be posted on www.childrensmovementflorida.org. Entrants who violate these Official Rules, violate any law, rule or regulation in connection with participation in the Promotion, tamper with the operation of the Promotion or engage in any conduct that is detrimental or unfair to Sponsor, the Promotion or any other entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from the Promotion. (Disqualification, however, shall not represent the sole remedy available to Sponsor.) Sponsor’s failure to enforce any provision of these Official Rules in any given circumstance shall not represent the waiver of such provision.
